DA Ruybalid’s disciplinary hearing continues today

DENVER — A two-day hearing that concludes today, may determine whether or not Third Judicial District Attorney Frank Ruybalid keeps his license to practice law.

The hearing is being conducted by the state supreme court’s presiding disciplinary judge William Lucero, of the Office of Attorney Regulation Counsel, who imposed a number of terms of probation on Ruybalid last year after the local DA pleaded guilty to a number of counts of misconduct which occurred in 2010-2013.

The hearing yesterday and today will determine if Ruybalid violated those terms of probation.

Lucero said, in January 2015, that Ruybalid dismissed numerous cases against criminal defendants due to failing to abide by state court rules concerning turning over discovery evidence to defense attorneys. Discovery rules mandate prosecutors turn over any and all evidence that negates or mitigates charges against a criminal defendant.

Allegations against Ruybalid say he has violated that rule at least three times since he was put on probation last year.

The Attorney Regulation Counsel helps the Colorado Supreme Court regulate the practice of law in the state through various programs. The office oversees attorney admissions, attorney registration, mandatory continuing legal and judicial education, attorney diversion and discipline, regulation of the unauthorized practice of law, and inventory counsel. Unlike in some other states, the Office of Attorney Regulation Counsel is a supreme court office and is not integrated with any bar association in its regulatory functions.
